happierhour.club is operated by Happier Hour Club Pty Ltd (ABN 53 694 709 129). By accessing or using our website, attending our events, or joining our community, you agree to these Terms of Use. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years of age to create an account, join our community, or attend happierhour.club events. By using our services, you represent and warrant that you are at least 18 years old.

3. Intellectual Property

All content on this website — including but not limited to the happierhour.club name, logo, “Happy. Not Hazy.” tagline, #HappyNotHazy hashtag, photography, copy, design, and brand assets — is the intellectual property of Happier Hour Club Pty Ltd and is protected under Australian intellectual property law.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any of our content or branding without prior written permission.

4. Use of the Website

You agree not to:

• Use the site for any unlawful purpose or in violation of these terms
• Attempt to gain unauthorised access to any part of the site or its systems
• Scrape, copy, or reproduce the site's content without permission
• Impersonate happierhour.club or misrepresent any affiliation with our community

5. User Accounts

When you create an account, you are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have breached these terms or engaged in conduct that is harmful to the community.

6. Community Membership

Membership to happierhour.club is by application and at our discretion. We reserve the right to accept, decline, or revoke membership at any time. Members are expected to conduct themselves respectfully and in alignment with our community values.

7. Events and Activities

happierhour.club organises physical and wellness-based activities including, but not limited to, contrast therapy (sauna and cold plunge), cycling, running, paddleboarding, padel, golf, and group dining. Participation in all events is voluntary and at your own risk.

Acknowledgement of Risk

By attending any happierhour.club event, you acknowledge and accept that physical activities carry inherent risks, including but not limited to:

• Contrast therapy: heat exposure, cold shock response, cardiovascular strain, and risks associated with extreme temperature changes
• Water sports: drowning risk, currents, marine hazards, and weather conditions (paddleboarding, surfing, swimming)
• Cycling: road hazards, traffic, falls, and equipment failure
• Running and sports: musculoskeletal injuries, heat-related illness, falls, and impact injuries

Medical Advisory

You should consult a medical professional before participating in happierhour.club events if you have any pre-existing medical conditions, including but not limited to heart conditions, blood pressure disorders, epilepsy, pregnancy, respiratory conditions, or any condition that may be affected by physical exertion or extreme temperatures. You are solely responsible for assessing your own fitness to participate.

Assumption of Risk

By attending an event, you voluntarily assume all risks associated with participation. While we take reasonable care to provide safe and enjoyable experiences, we are not liable for any injury, loss, or damage arising from your attendance at or participation in our events, except to the extent that liability cannot be excluded by law.

Event details, including dates, venues, and activities, are subject to change. We will make reasonable efforts to notify participants of any material changes.

8. Ticketing and Payments

Event tickets are sold through Humanitix, a third-party ticketing platform. When you purchase a ticket, you are also subject to Humanitix's terms and conditions. We do not process or store payment card information directly.

Refund requests for event tickets should be directed to happy@happierhour.club. Refunds are assessed on a case-by-case basis and are subject to the applicable Humanitix refund policy.

9. Photography and Media

Our events may be photographed and/or filmed. By attending a happierhour.club event, you consent to the capture and use of your likeness in photographs and video for promotional, marketing, and community purposes, including use on our website and social media channels.

If you do not wish to be photographed or filmed, please notify an event organiser at the event, and we will make reasonable efforts to accommodate your request.

10. Electronic Communications

By creating an account, you consent to receive transactional emails from us related to your account and event participation (such as registration confirmations and password resets). These communications are necessary for the operation of your account and are not marketing messages.

We will only send you marketing emails (such as event announcements and community news) if you have expressly opted in to receive them. You can unsubscribe from marketing emails at any time using the unsubscribe link provided in each email, in accordance with the Spam Act 2003 (Cth).

11. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for full details on how we collect, use, hold, and disclose your personal information in accordance with the Australian Privacy Principles.

12. Limitation of Liability

To the maximum extent permitted by law, Happier Hour Club Pty Ltd and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of this website or participation in our events and community.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

13. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by updating the “Last updated” date at the top of this page and, where practicable, by email or notice on the website. Your continued use of the site or participation in our community after any changes constitutes acceptance of the updated terms.

14. Governing Law and Disputes

These terms are governed by and construed in accordance with the laws of Western Australia, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Western Australia for the resolution of any disputes arising under or in connection with these terms.
